Terms of Service

1. Agreement

By accessing or using SplashEdit (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. SplashEdit is operated by fshbwl.ai LLC, a California limited liability company.

2. Eligibility

You must be at least 16 years old to use SplashEdit. By using the Service, you represent that you meet this requirement.

3. Accounts

You sign in using Google, Facebook, or email magic link authentication. You are responsible for maintaining the security of your authentication account. You are responsible for all activity that occurs under your SplashEdit account.

4. Your content

You retain full ownership of all photos, dive logs, and other content you upload to SplashEdit (“Your Content”). We do not claim any intellectual property rights over Your Content.

By uploading content, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing the Service to you. This license ends when you delete Your Content or your account.

4a. AI-powered features

SplashEdit offers optional AI-powered features including color correction, species identification, backscatter detection, image quality scoring, and AI Reimagine (generative photo enhancement). These features require AI credits and your explicit consent (opt-in via Settings > Privacy).

Your photos, your control. AI features only process photos you explicitly submit. We do not automatically scan your photo library. You choose which photos to analyze.

AI-generated content. When you use AI Reimagine, the output is a new AI-generated image based on your original photo. You own the AI-generated output. However, AI-generated images are labeled as such (“AI Reimagined”) in the app and in photo metadata (XMP). Your original photo is never modified by AI processing.

Accuracy disclaimer. AI features provide suggestions and analysis, not guarantees. Species identification may be incorrect. Color correction is automated and may not match your creative intent. AI Reimagine produces creative variations that may alter details from the original scene. Always verify AI results before relying on them for safety, identification, or documentation purposes.

AI credits. Certain AI features consume credits from your account. Credit costs are displayed before each operation. Credits are non-refundable once consumed (i.e., once the AI has processed your request), except in cases of service failure where no result was delivered. Monthly Pro credits reset on your billing cycle date. Purchased credit packs do not expire.

5. Acceptable use

You agree not to:

• Upload illegal, harmful, or infringing content
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use the Service to distribute malware or spam
• Reverse-engineer, scrape, or otherwise interfere with the Service
• Use automated tools to access the Service beyond normal usage

Your use of SplashEdit is also governed by our Community Guidelines, which describe in detail what content is and isn’t allowed. We may suspend or terminate your account if you violate these terms or the Community Guidelines.

6. Service availability

SplashEdit is provided “as is” and “as available.” We do not guarantee uninterrupted, secure, or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

As an early-stage startup, we are transparent about the fact that the Service may change significantly or be discontinued. We will make reasonable efforts to notify users before any major changes, but we encourage you to maintain your own backups.

7. Free and paid tiers

SplashEdit offers a Free tier and a Pro tier ($7.99/month, monthly billing). Free includes unlimited dive logging, basic photo editing, and limited photo storage. Pro includes expanded storage, AI features, dive computer import, and additional capabilities. AI credit packs ($6.99/100 credits, $29.99/500 credits) are available as one-time purchases.

We reserve the right to change pricing, features, and usage limits at any time. If you are on a paid plan and we make changes that materially reduce the service, you may cancel for a full refund of any unused prepaid period. Supporter Tip Jar contributions are voluntary and non-refundable.

8. Limitation of liability

To the maximum extent permitted by law, fshbwl.ai LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of photos, arising from your use of the Service.

Our total liability for any claim arising from these terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

9. Privacy

Your use of SplashEdit is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. We are committed to GDPR compliance.

10. Data protection

We respect your data rights under the GDPR and similar regulations. You can:

• Delete your account — in Settings, which permanently removes all personal data, dive logs, photos, and S3 objects
• Export your data — download a ZIP archive of your profile, dives, photos, and favorites
• Manage consent — opt in or out of GPS coordinate storage at any time
• Manage AI consent — opt in or out of AI photo analysis at any time in Settings > Privacy. Withdrawing consent stops all AI processing and removes AI-generated tags and descriptions from your photos.

11. Termination

You may delete your account at any time via Settings > Danger Zone. Upon deletion, all personal data, dive logs, photos, and stored files are permanently removed. Anonymized audit logs are retained. We may also terminate or suspend your account if you violate these terms or if we discontinue the Service.

12. Governing law

These terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.

13. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by email or by a notice on the site. Your continued use of SplashEdit after changes take effect constitutes acceptance of the revised terms.
